Human Resources: 2018 Immigration Enforcement, Can it Affect Your Business?



Employers have certain responsibilities under immigration law during the hiring process! All employers must complete and retain Form I-9, Employment Eligibility Verification, for every person they hire for employment in the U.S. as long as the person works for pay or other type of payment.

In order to discuss this topic further, let’s first address the most basic question…

What is the Form I-9?

As stated on, “Form I-9 is used for verifying the identity and employment authorization of individuals hired for employment in the United States. All U.S. employers must ensure proper completion of Form I-9 for each individual they hire for employment in the United States.”

Most recently, on January 10, 2018, federal immigration agents targeted around one hundred 7-Eleven stores across the country. Twenty-one people were arrested and the businesses will be required to produce I-9 forms for all employees in order to prove work authorization.

This raid will no doubt result in massive fines and potentially jail time! How do you, as a business owner, be sure to avoid a situation like this? 

The best way for a business to avoid any issues is by developing a thorough I-9 compliance program. This program should include training for any employee who may be responsible for on boarding new employees. An audit can be done to ensure that a company is compliant.

What are a few of the biggest mistakes that are made by employers when handling I-9 forms?

  1. Not having I-9s!
  2. Allowing untrained staff to administer I-9s.
  3. Not conducting an internal I-9 audit
  4. Not supervising new employees filling out Section 1, which causes many Section 1 mistakes.
  5. Accepting unacceptable documents.
  6. Using white out or crossing out.
  7. Making corrections without initializing and dating them.
