Starting May 8, 2025, New York City’s lactation accommodation law will require employers with four or more employees to post their lactation room accommodation policy in a conspicuous place that’s accessible to all employees. The policy must also be posted on the employer’s intranet if they have one. These new posting requirements are in addition to the current requirement that employers provide the policy upon hire.

The amended law also requires that the policy be updated to include the state’s requirement to provide 30-minute paid lactation breaks and allow employees to use existing paid break or meal time for any additional time beyond the 30 minutes.

We hoped that the NYC Commission on Human Rights would update its ⁠Model Lactation Accommodation Policies to reflect the changes by the time we sent this alert, but the policies currently on the linked page have not been updated yet. When looking for updates in the future, check the top right corner of the notices to see if they have a date of 2025 or later.
