Idaho now prohibits employers from requiring employees to receive vaccination against COVID-19. The Coronavirus Stop Act, which applies to employers of all sizes, took immediate effect on April 6, 2023.
The law prevents employers that do business in the state of Idaho from requiring a COVID vaccination as a condition of employment unless one or more of the following is true:
It’s required by federal law
It’s necessary for business travel to a location outside of Idaho because vaccination is required by the destination government and is the only acceptable means of entry
It’s necessary for business travel to a location outside of Idaho because vaccination is required by an establishment the employee needs to enter (e.g., client office, conference center, event venue) and is the only acceptable means of entry
If an employee is required to get a COVID vaccination for travel, they must either have a written employment contract that includes this as a condition of employment or be given no less than 14 days’ written notice before being required to receive the COVID vaccination.
