Starting July 1, 2025, employers with six or more employees in New Hampshire will be required to provide employees with certain lactation accommodations unless doing so would be an undue hardship (i.e., a significant difficulty or expense). We’ve included the requirements that go above and beyond federal law.
Lactation Space
Employers need to provide a space that’s within a reasonable walking distance of the employee’s worksite, unless the employee and employer agree to a different location. If feasible, the space needs to include an electrical outlet and a chair. It must also (and we hope this didn’t need saying) be clean.
If the space isn’t designated for lactation full time, it needs to be accessible to employees whenever they request it.
Lactation Policy
Employers will need to adopt a policy that notifies employees about their lactation rights and make it available to employees upon hire.
Action Items
Update your lactation policy as needed and provide it to all new employees. If you use our Smart Employee Handbook, simply accept the update when you receive the platform notification.
Designate a space in the workplace that can be used for lactation and make sure it complies with the above requirements.
